Terms of Service
Effective Date: March 9, 2026
Last Revised: March 9, 2026
Operated by: BayGull AI
1. Acceptance of Terms
These Terms of Service (“Terms”) form a legally binding agreement between you (“you” or “User”) and BayGull AI (“we,” “us,” or “our”), the operator of StarPrepare.
BY CLICKING “I AGREE,” CREATING AN ACCOUNT, OR USING THE SERVICE IN ANY WAY, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
If you are using StarPrepare on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Your continued use of the Service following any posted updates constitutes acceptance of the revised Terms, subject to Section 15 (Changes to Terms).
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding contract in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement.
We do not knowingly permit users under 13 years of age to register or use the Service. If we discover that a user is under 13, we will promptly delete their account and associated data. If you believe we have inadvertently collected data from a child under 13, please contact us immediately at hello@starprepare.com.
3. Description of Service
StarPrepare is an AI-powered behavioral interview preparation application. The Service generates STAR-format (Situation, Task, Action, Result) responses based on information you provide, facilitates interview practice, and allows iterative refinement of your responses.
The Service is powered by artificial intelligence. All responses and suggestions are generated by automated AI systems, not by human professionals. StarPrepare does not provide professional career advice, legal advice, or any other form of professional services, and nothing generated by the Service should be treated as such.
The Service relies on third-party technologies including Firebase Authentication (Google LLC), RevenueCat (in-app purchases), PostHog (analytics), Sentry (crash reporting), and OpenRouter (AI model gateway). Your use of the Service involves data processing by these third parties, as described in our Privacy Policy.
4. User Accounts
Accounts are created and managed via Firebase Authentication. You must provide accurate, current, and complete information when registering. Each person may maintain only one account.
You are solely responsible for:
- Maintaining the confidentiality of your login credentials;
- All activity that occurs under your account;
- Notifying us immediately at hello@starprepare.com of any unauthorized use or security breach.
We are not liable for losses arising from unauthorized account access that result from your failure to safeguard your credentials.
5. Credits and Payments
5.1 Credit System. StarPrepare uses a credit-based system where 1 credit = USD $0.001. Credits are a limited, non-transferable license to use specific Service features. Credits have no real-world monetary value, cannot be transferred between accounts, and cannot be redeemed for cash.
5.2 Purchases. Credits are purchased through in-app purchases managed by RevenueCat. The merchant of record for iOS purchases is Apple; for Android purchases, it may be Google or BayGull AI depending on configuration. Each platform’s own purchase terms apply.
5.3 Service Error Refunds. If a credit-consuming AI generation fails due to a verified error on our end, the credits consumed will be automatically restored to your account within 24 hours.
5.4 General Refund Policy. All credit purchases are non-refundable once credits have been consumed. Unused credits may be refunded at our discretion within 30 days of purchase if you contact hello@starprepare.com. This policy does not limit any rights you may have under applicable mandatory consumer protection law in your jurisdiction that cannot be waived by contract, including statutory refund and cancellation rights. If you believe such rights apply to you, please contact us and we will honor them.
5.5 Taxes. You are responsible for all applicable taxes associated with your purchase.
6. Acceptable Use
You agree to use the Service only for lawful, personal, non-commercial interview preparation purposes. You agree not to:
- Use bots, scripts, automated tools, or scrapers to access the Service;
- Share your account credentials or allow any third party to access the Service through your account;
- Use the Service to fabricate professional experience, credentials, or achievements you do not genuinely possess;
- Use AI-generated content to misrepresent your background, qualifications, or experience in job applications in a manner that constitutes fraud or deception;
- Reverse-engineer, decompile, or attempt to extract the source code or algorithms underlying the Service;
- Interfere with or disrupt the integrity or availability of the Service;
- Use the Service in violation of any applicable law or regulation;
- Resell or commercialize access to the Service without our prior written consent.
The Service is designed to help you articulate your genuine, real-world experiences. You represent that all information you input is truthful. You bear sole responsibility for ensuring that any responses you use in interviews accurately reflect your actual background.
Violation of this Section may result in immediate account termination and may expose you to legal liability.
7. AI-Generated Content — Important Disclaimers
ALL CONTENT GENERATED BY STARPREPARE IS PRODUCED BY ARTIFICIAL INTELLIGENCE AND IS PROVIDED AS A SUGGESTION ONLY.
AI-generated content may be inaccurate, incomplete, or unsuitable for your specific situation. AI systems are also subject to “hallucination” — the generation of plausible-sounding but factually incorrect or fabricated information. You are solely responsible for reviewing, verifying, and editing all AI-generated content before use.
Before using any AI-generated response in an actual interview or application, you must:
- Verify that all details and specific claims accurately reflect your real experience;
- Confirm that no fabricated or hallucinated details have been incorporated;
- Exercise your own independent professional judgment.
We make no representation, warranty, or guarantee that use of the Service will result in successful interview performance, job offers, or any other employment outcome. You are always interacting with an AI system, not a human professional.
8. Intellectual Property
8.1 Your Content. You retain ownership of all original content you submit to the Service, including your resume, profile information, and text inputs. You grant BayGull AI a limited, non-exclusive, royalty-free license to process your content solely to provide the Service to you. This license terminates when your account is deleted.
8.2 AI-Generated Outputs. BayGull AI makes no ownership claim over AI-generated responses produced from your content. You are free to use them subject to these Terms. However, you acknowledge that under current law (including US Copyright Office guidance), purely AI-generated content without substantial human creative authorship may not qualify for copyright protection. Your own human-authored edits and additions to AI-generated content may be separately protectable.
8.3 No Training on Your Data. BayGull AI does not use your content — including resume data, profile information, or personal inputs — to train, fine-tune, or improve any AI model. Resume and profile data is processed transiently during API requests and is not stored beyond the duration of those requests.
8.4 BayGull AI’s Property. BayGull AI and its licensors retain all rights in the Service, including its algorithms, software, interface, branding, and technology. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service as permitted by these Terms. Nothing in these Terms transfers any ownership of BayGull AI’s intellectual property to you.
8.5 Feedback. If you provide feedback or suggestions about the Service, you grant BayGull AI a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.
9. Disclaimers and Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAYGULL AI EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING:
- Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
- Warranties that the Service will be uninterrupted, error-free, or free from harmful components;
- Warranties regarding the accuracy, completeness, or reliability of any AI-generated content;
- Warranties that the Service will achieve any particular interview or employment result.
We do not warrant or assume responsibility for the performance or privacy practices of any integrated third-party services.
Where applicable law does not permit the exclusion of certain implied warranties or statutory consumer rights, these disclaimers apply only to the fullest extent permitted by law.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAYGULL AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, REPUTATIONAL HARM, OR DAMAGES ARISING FROM RELIANCE ON AI-GENERATED CONTENT.
BAYGULL AI’S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO BAYGULL AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) USD $10.00.
Nothing in this Section limits BayGull AI’s liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; (c) gross negligence or willful misconduct; or (d) any liability that cannot be excluded or limited under applicable mandatory law, including statutory consumer rights that cannot be contracted out of.
11. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BayGull AI and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your violation of these Terms;
- Your use of the Service in an unauthorized manner;
- Your submission of false, inaccurate, or misleading information to the Service or in any job application using AI-generated content from the Service;
- Your infringement of any third-party intellectual property rights; or
- Your violation of any applicable law.
12. Dispute Resolution
12.1 Informal Resolution. Before initiating any formal dispute, you agree to contact us at hello@starprepare.com to attempt to resolve the matter informally. We will endeavor to resolve the dispute within 30 days.
12.2 Binding Arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, applying California law, in San Francisco, California (or by remote hearing at your election). The arbitrator’s award is final and binding.
12.3 CLASS ACTION WAIVER. ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR COLLECTIVE PROCEEDING. If a court finds this waiver unenforceable as to a particular claim, that claim shall be litigated in court while all other claims proceed in arbitration.
12.4 Small Claims. Either party may bring qualifying claims in small claims court on an individual basis in lieu of arbitration.
12.5 Opt-Out. You may opt out of binding arbitration within 30 days of first creating your account by sending written notice to hello@starprepare.com with the subject line “Arbitration Opt-Out.”
12.6 Mandatory Consumer Rights. Nothing in this Section prevents you from exercising any rights before a consumer protection authority, tribunal, or regulator under mandatory applicable law in your jurisdiction that cannot be waived by contract.
13. Termination
13.1 Termination by You. You may delete your account at any time through the app or by contacting hello@starprepare.com. Upon deletion, your right to use the Service ceases immediately.
13.2 Termination for Cause. We may immediately suspend or terminate your account without prior notice if you violate Section 6, engage in fraudulent or illegal conduct, or take any action that poses a risk to the security of the Service or other users.
13.3 Termination Without Cause. We may terminate your account for any reason upon 30 days’ written notice to your registered email address. In such cases, we will refund any unused credit balance at the time of termination.
13.4 Effect of Termination. Upon termination, all licenses granted to you cease immediately. Sections 7, 8, 9, 10, 11, 12, 17, and 19 survive termination.
14. Force Majeure
BayGull AI shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, government action, internet outages, third-party infrastructure failures, or power failures. We will notify you as soon as practicable and resume performance as conditions allow.
15. Changes to Terms
We may update these Terms from time to time. For material changes — those that meaningfully affect your rights or obligations — we will:
- Post a notice on the Service at least 30 days before the change takes effect; and
- Send an email notification to your registered email address.
For non-material changes (typographical corrections, clarifications), we may update without prior notice. Continued use of the Service after the effective date of any update constitutes acceptance. If you do not agree to updated Terms, you may close your account before they take effect.
16. Privacy
Your privacy is important to us. Our Privacy Policy explains what data we collect, how we use it, with whom we share it, and how you can exercise your rights. The Privacy Policy is incorporated into and forms part of these Terms. By using the Service, you consent to data processing as described in the Privacy Policy.
Privacy inquiries may be directed to: hello@starprepare.com
17. Third-Party Services
The Service may link to or integrate with third-party services. We do not control, and are not responsible for, the content, terms, or privacy practices of any third-party service. Your use of third-party services is governed solely by their own terms and policies.
18. Entire Agreement and Severability
18.1 Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and BayGull AI regarding the Service and supersede all prior communications, representations, and agreements.
18.2 Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will continue in full force and effect.
18.3 No Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
18.4 Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. BayGull AI may freely assign these Terms (e.g., in connection with a merger or acquisition), provided the assignee agrees to be bound by them.
19. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. For disputes not resolved under Section 12, you and BayGull AI consent to the exclusive jurisdiction of the state and federal courts in San Francisco County, California.
Nothing in this Section overrides rights that cannot be waived under mandatory consumer protection or privacy laws applicable in your jurisdiction.
20. Communications
By creating an account, you consent to receive electronic communications from BayGull AI related to your account and the Service. You may opt out of non-essential (marketing) communications at any time via the unsubscribe link in those messages or by contacting hello@starprepare.com. Opting out does not affect transactional account notices.
21. Accessibility
BayGull AI is committed to making the Service accessible to users with disabilities. We strive to follow WCAG 2.1 Level AA guidelines where technically feasible. If you encounter accessibility barriers, please contact hello@starprepare.com and we will make reasonable efforts to assist you.
